Ghana Medical Association raises concern over stalled vehicle tax waiver implementation

The Ghana Medical Association (GMA) has raised concerns over the stalled implementation of the vehicle importation tax waiver granted to medical doctors and dentists under their Conditions of Service agreement.

In a statement dated February 19, 2025, the association attributed the delays to a change in government, which has led to a halt in the processing of waivers, leaving some applications pending final approval from the Ministry of Finance.

“This has resulted in vehicles being stuck at the port, accumulating charges by the day and risking confiscation and auction,” the statement stated.

The waiver, which was part of an agreement signed on March 27, 2024, was meant to help medical professionals secure vehicles to facilitate their work, including responding to emergencies.

However, with the current hold on processing, many doctors who imported vehicles are now facing demurrage charges and possible financial losses.

“The Executives have been engaging various stakeholders to resolve the delays and work towards a resumption of the waiver,” the GMA assured its members.

The association urged affected doctors to exercise patience as discussions with the Ministers of Health and Finance continue. It also advised members considering vehicle importation under the waiver to put their plans on hold.

“Applicants with the means may also consider clearing their cars to minimize accumulation of port and demurrage charges,” the statement added.

The National Executive Council (NEC) of the GMA reaffirmed its commitment to resolving the issue and ensuring that the tax waiver, which is a key component of their Conditions of Service, is reinstated as soon as possible.

In the midst of heightened discussions about Mark Okraku-Mantey’s ‘unsatisfactory’ performance as Deputy Minister of Tourism, Arts, and Culture, we reflect on what Dzifa Gomashie said about the role of a “Deputy Minister” some time ago.

In a three-year-old interview with CitiTV, Dzifa Gomashie, who was once a former Deputy Minister of Tourism and Creative Arts, addressed the criticisms surrounding Mark Okraku-Mantey’s performance at the time.

She asked that people cut him some slack.

Dzifa Gomashie described the position of Deputy Minister as a “token” role, explaining that anyone in that position isn’t empowered to make decisions, even if their suggestions are what needs to be done.

“It’s good to be in there but it’s a token. As a Deputy Minister, you don’t make the decisions. I’m wishing Mark well because you don’t take the decisions, and it doesn’t matter if what you’re saying is what should be done,” she said.

She also questioned how one representative from the creative arts industry could be assigned to a “complimentary” deputy minister role, yet people expect him to completely turn things around overnight.

“This whole industry, one person sits in the Deputy Minister role and you think they can change what? No! It’s an institutionalized problem of not placing value on the sector. It’s not about one individual sitting there,” she added.

She continued, “I ask again, when did we have a ministry that included creative arts?”

Since Mark Okraku-Mantey assumed office in January 2021, expectations had been high.

Many stakeholders believed that having one of their own in charge would finally bring positive change to the long-neglected arts and tourism industry.

However, things took a different turn as their long list of expectations, in their perspective, were not met to their satisfaction.

They cited neglect, empty promises, sabotage, and even bitterness toward Okraku-Mantey until he left office.

Despite the criticism, many also defended him, stating that he only sides with his boss on decisions rather than making them.

Others have said he should be credited for boosting the tourism sector, doing a good job with the Year of Return initiative, attracting investors, collaborating with international stakeholders such as Global Citizen, and many others, giving Ghana’s tourism a facelift.

Nana Aba Anamoah’s recent outburst, in which she described Mark Okraku-Mantey’s performance as “zilch” and stated that he doesn’t deserve to be called “Honourable,” sparked this conversation around his tenure.

Court orders Ghana Immigration Service to pay GH¢910,000 in damages for wrongful travel restriction

The Ghana Immigration Service has been ordered by a court to pay a total of GH¢910,000 in damages and lost earnings to Ghanaian citizen Kwabena Baffour Asare.

According to court documents shared by The Law Platform, the High Court, which heard the case, delivered its verdict in favor of the plaintiff, Kwabena Baffour Asare, after the Ghana Immigration Service prevented him from boarding a flight to Germany in June 2022. This incident resulted in the loss of his job, where he had worked for 30 years.

Legal counsel representing the plaintiff, Kwabena Baffour Asare, stated that Asare, a resident of Berlin, Germany, traveled to Ghana in May 2022 to attend his late mother’s funeral and planned to return to Germany on June 17, 2022.

They explained that upon arriving at the Kotoka International Airport and completing the pre-boarding procedures, Asare was apprehended and detained by immigration officials. The officials justified their actions by claiming that Asare was on their wanted persons list and that they were acting on a request from the Ghana Police Service.

He was subsequently taken from detention to the head office of the Ghana Immigration Service and later, on June 18, 2022, handed over to the police, where his statement was recorded. However, the police released him after realising that he was not the person they were searching for and that the incident was a case of mistaken identity.

The person sought by the police also shared the name Kwabena Asare and resided in Germany, leading to confusion and subsequent mistaken identity.

The counsel further added that following the ordeal, the plaintiff, Kwabena Baffour Asare, attempted to board his flight back to Germany later in the evening of June 18, 2022, after being released by the police.

However, he was once again prevented from boarding by immigration officials, who reiterated the same reason—claiming he was on the wanted persons list. This was despite the victim presenting a police extract confirming that he was not the wanted person.

In the end, the counsel disclosed that his client was once again prevented from traveling, a decision they argued violated Baffour Asare’s rights. They further stated that this obstruction led to his job loss in Germany, where he had been earning a substantial income.

Although the defendants, the Ghana Immigration Service, denied the claim, stating that they acted in good faith without any malicious intent and not negligently as alleged by the plaintiff, the judge, His Lordship Justice Ayitey Armah-Tetteh, ruled in favor of the plaintiff.

The judge awarded GH¢910,000 to compensate Kwabena Baffour Asare for his job loss, with a breakdown as follows: general damages of GH¢650,000.00 for negligence and the unjustifiable violation of the plaintiff’s rights, loss of earnings amounting to GH¢250,000.00, special damages of GH¢10,000.00, and costs of GH¢50,000.00 in favor of the plaintiff.

You may have first heard the term “Sinking Fund” when news broke that President John Dramani Mahama directed the Ministry of Finance to settle outstanding Domestic Debt Exchange Programme (DDEP) coupons and build a financial buffer through the Fund.

For those who may have come across the term but do not fully understand it, this GhanaWeb Business article provides a breakdown of what a sinking fund is, its purpose, and why it is important to have one in place.

A sinking fund, according to the Corporate Finance Institute, is a type of fund specifically created for repaying debt.

The account holder’s responsibility is to set aside a certain amount of money on a weekly, monthly, or quarterly basis for a particular purpose whether for debt repayment, education, a wedding, or other financial goals.

In finance, a sinking fund is mostly used by corporations for bonds, where money is deposited to buy back issued bonds or portions of bonds before their maturity date.

“It is also one way of enticing investors because the fund helps convince them that the issuer will not default on their payments,” the Corporate Finance Institute noted.

Simply put, a sinking fund is created to make debt repayment easier and to ensure that default does not occur by setting aside sufficient funds to meet obligations.

Although most bonds take several years to mature, having a sinking fund allows for gradual repayment of the principal amount, reducing credit risk over time.

A sinking fund cannot be created in isolation, as there are regulations governing its management to ensure proper oversight and accountability.

Sinking funds must be invested in accordance with guidelines set by regulatory bodies, such as the Bank of Ghana or the Securities and Exchange Commission.

Having this type of fund provides a sense of financial security, as the money is reserved for a specific purpose.

It differs from a regular savings account, which can be used for multiple financial needs. While both serve to enhance financial stability, a sinking fund is designated solely for a predetermined financial obligation, such as debt repayment.

Background

President John Dramani Mahama has directed the Ministry of Finance to settle outstanding Domestic Debt Exchange Programme (DDEP) coupons and build a financial buffer through the Sinking Fund.

In line with this directive, on Monday, February 17, 2025 the Ministry of Finance disbursed a Payment-In-Cash (PIC) coupon of GH¢6.081 billion to all DDEP bondholders.

Additionally, a Payment-In-Kind (PIK) portion of GH¢3.46 billion has been credited to bondholders’ securities accounts, in accordance with the terms outlined in the DDEP Memorandum.

To further strengthen the country’s debt management strategy, the government has also deposited GH¢9.7 billion into the Debt Service Recovery Cedi Account (Sinking Fund).

This move is intended to serve as a buffer for the next five DDEP coupon payments due in July and August 2025.
