Mbah prays court to dismiss NYSC’s objection against N20bn suit

Governor Peter Mbah of Enugu State on Tuesday, prayed a Federal High Court, Abuja to dismiss the preliminary objection filed by the National Youth Service Corp (NYSC) against his N20 billion suit over alleged certificate forgery.

Mbah’s counsel, Christopher Oshomegie, SAN, urged Justice Inyang Ekwo to dismiss the objection on the grounds that sections cited in the NYSC Act were not applicable in the instant suit.

He said a counter affidavit and a written address had been filed in response to the preliminary objection.

“We adopt our written address as our oral argument to the preliminary objection in urging my lord to dismiss their application,” he said.

Earlier, counsel for the NYSC, Aminu Sadauki, told the court that the matter was fixed for today for hearing of their objection.

The lawyer, who adopted the objection, argued that Mbah contravened the NYSC Act in the institution of the suit.

He said Mbah did not appeal to the President as required by the provisions of Section 20 of the NYSC Act before instituting the suit against them.

He urged the court to strike out the suit for want of jurisdiction and competence.

But in a counter affidavit filed by Mbah, the governor told the court to dismiss NYSC’s objection on the ground that he was neither a serving corps member or an employee of the corps.

According to him, Section 20 of the NYSC Act, which NYSC’s lawyer referred to does not applied to him.

4 policemen killed by Bandits at checkpoint in Zamfara

Armed bandits in large numbers have ambushed and killed four policemen along Gusau – Bungudu road area in Zamfara state.

The policemen were serving under Bungudu Local Government Area of Zamfara when they were attacked on Monday night in the state. 

A resident of Bungudu town, Mallam Umar, disclosed to the Nigerian tribune that four of the policemen were killed during the incident.

“Bandits in their large number killed four police in Bungudu yesterday night; they ambushed the police along Gusau Bungudu Road close to Nabature , they also catered away many cattle at Tagero village under Furfuri district of Bungudu area”.

It was gathered that the police were said to have mounted a checkpoint along Bungudu-Gusau Road when the armed bandits ambushed and opened fire on them.

When contacted on the phone, the spokesperson for the Zamfara State Police Command, ASP Yazid Abubakar, confirmed the attack.

However, ASP Yazid could not confirm if any policemen were killed during the incident, saying he would provide more details later in the state.

Court Remands Skit Maker Trinity Guy, Victim’s Parents

A family court in Iyaganku, Ibadan, on Tuesday, ordered that a skit maker Maruf Abdullahi, aka ” Trinity”, be remanded in Agodi correction centre for allegedly sexually exploiting a 10-year-old girl.

The magistrate, P. O. Adetuyibi, ordered Mr. Abdullahi, 31, and the parents of the child – Isiaka Ahmed, 40, and his wife, Rofiat Ahmed, 29, to continue to be remanded in Agodi.

Police charged Mr Abdullahi alongside the parents of the victim with conspiracy and sexual abuse/exploitation.

Earlier, the prosecution counsel, Oluwakemi Arowosaye, told the court that the accused persons allegedly conspired together to wit sexual abuse.

Mr Arowosaye said ‘Trinity” on 17 December 2022, was alleged to have sexually abused and exploited the 10-year-old girl at Kuola area, Ibadan.

The offense, the police said, contravened the provisions of Section 35 (1) and is punishable under Section 35 (2) of the Oyo State Child Rights Law 2006.

She said it also contravenes the provisions of section 516 of the Criminal Code Laws of Oyo State 2000.

Court Hands Police Lawyer To EFCC For Filing Criminal Charges Against Senator Stella Oduah

Justice James Omotosho of the Federal High Court sitting in Abuja on Tuesday, handed a police lawyer, Ibrahim Mohammed to the Economic and Financial Crimes Commission for filing a criminal charge against Senator Stella Oduah.

Justice Omotosho directed the EFCC to investigate Mr. Mohammed in view of the 8-count criminal charges he filed against the former Minister of Aviation in the name of EFCC without the authority of the anti-graft agency.

Senator Oduah was to be arraigned before the court over alleged complicity surrounding her National Youth Service Corps certificate and fraudulently receiving money from the Federal Government.

However, when the matter was called, Mrs Oduah was conspicuously absent in court and the Judge sought to know why she was not present in court.

Replying, Mohammed who introduced himself as a lawyer with the Police Legal Department, Force Headquarters, Abuja, informed the court that the Oduah was not in court because she has not been served with the charge.

Mohammed said Senator Oduah had told the police that she was not feeling well when invited to come for the charge.
