Lawyers representing the State on Tuesday told the 3-bench judges that Judiciary had no jurisdiction to nullify the impeachment of Rigathi Gachagua.
They said the Senate’s decision is final. National Assembly lawyer Benson Milimo said that the House conducted an unprecedented public participation.
Lawyer representing the Senate, Prof Tom Ojienda, claimed that Gachagua was presented with an opportunity to be heard, arguing that his lawyer did not present evidence from doctors to show that he was in hospital.
Ojienda said that it was against the public interest to freeze the impeachment process at the Senate.
The Kisumu Senator also argued that in the event the court finds that Gachagua’s rights were violated, he can be compensated in terms of money.

The United Democratic Alliance (UDA) will replace the Gachagua as the party’s deputy, Secretary-General Omar Hassan has said.
Speaking on Tuesday, October 29, 2024, Hassan indicated that the party’s National Executive Committee (NEC) would convene a meeting at the tail end of the court ruling and come up with a new deputy party leader.
Hassan noted that the relationship between Gachagua and the president was strained and that they could no longer work together.
He indicated that Gachagua’s goose was cooked the moment he seemed to be pulling in a different direction from President William Ruto in his call for unity and policy directions.
