Impeached DP Gachagua Writes Letter To Judiciary, Questions The Following

Deputy President Rigathi Gachagua has written to the Judiciary, raising concerns about how one of the cases challenging his impeachment landed before a three-judge bench without the express directive of Chief Justice Martha Koome. In his letter, Gachagua’s legal team questioned the transparency and fairness of the process, suggesting irregularities in the handling of the case.

Gachagua’s move comes in the wake of his ongoing impeachment battle, where the High Court recently declined to halt parliamentary proceedings. Justices Eric Ogola, Freda Mugambi, and Anthony Mrima, who heard the matter, ruled that Gachagua still had a chance to defend himself before the Senate, and the court could not intervene at this stage.

The Deputy President’s lawyers, led by senior counsel Paul Muite, have been vocal in their criticism, accusing the bench of overstepping by entertaining the case on a weekend. Gachagua’s team insists that these judicial decisions are politically motivated and aimed at rushing the impeachment process.

The letter to the Judiciary reflects Gachagua’s growing frustration with the legal process, especially after the court rejected multiple efforts to stop his impeachment hearings. His defense team has continuously raised concerns about due process, emphasizing that such a sensitive case should follow proper legal procedures, starting with directives from the Chief Justice herself.

This development comes amidst a tense political climate, with Gachagua claiming his life is in danger and alleging poisoning attempts as part of a broader scheme to oust him from office. His camp sees the impeachment as a calculated move to remove him from power, while legal experts argue that the judiciary’s role is to ensure fairness and constitutional adherence throughout the process.
