Kindiki’s Approval as New DP at Risk as Clause of Constitution Which Wasn’t Adhered to Emerge

Kithuri Kindiki’s move to succeed Rigathi Gachagua as the new deputy president is facing a legal battle with senior legal counsels tabling articles of the Constitution which might block him from taking over as the DP.
As reported by Sunday’s standard publication, Lawyer Willis Otieno claims that Rigathi Gachagua is the only deputy president as per the law.
He noted that High Court’s orders to cancel senate’s resolution applied from the time the speaker announced DP Gachagua’s Impeachment.
Also, Lawyer Miguna Miguna claims that article 137 of the constitution might lock Kithuri Kindiki out of deputy president post.
” How about clause 137 of the constitution which states that a person who holds a public office is not qualified to be nominated as a president or deputy president”, miguna revealed.
Therefore, the clause is a threat to Kithuri Kindiki considering the fact that he was holding the interior ministry docket as a CS .
It should be noted that his swearing in event was pushed until next week following high court’s Orders as Rigathi Gachagua moves to thwart his ouster as deputy president.
