Details That A Deputy Chief Justice Can Appoint Tribunal To Remove President From Office Emerge

The Impeachment case touching on the former Second in Command DP Rigathi Gachagua who was ousted from office after the Senate voted to kick him out has brought together top legal minds in the country to argue as a battery of lawyers led by SC Paul Muite continue putting a spirited fight to get justice for their client.
A lot of drama has ensued in the courtroom throughout the day with the three judges presiding over the case being asked to recuse themselves following their appointment by the Deputy Chief Justice Philomena Mwilu.
SC Paul Muite has opposed the manner in which the courts conducted themselves and the oddly hours in which the three judges appointed. Gachagua’s lawyers also pointed out that the Deputy Chief Justice has no authority to appoint the bench presiding over Gachagua’s case.
However, Githu Muigai has defended the Philomena Mwilu and the judges and had this to say:
“The Deputy Chief Justice can appoint a tribunal to remove the President from office. What a huge responsibility and authority but what a minute, the Deputy Chief Justice cannot assign duties to judges. If the Deputy Chief Justice cannot assign duties to Judges, what then does she deputize?”
