The DP will now be expected to face the senate Plenary after the 3 judge bench declines to stop the process.
Rigathi Gachagua’s last attempt to stop the impeachment proceedings at the Senate has failed.
The three-judge bench led by Justice Eric Ogola allowed the Senate to debate and vote on the impeachment motion.
The judges explained why they declined to issue orders that could have saved Gachagua. The 3 judges that were appointed by the CJ Koome have agreed that the principle of separation of powers is what led them to allow the senate do it’s mandate.
