Former Deputy Attorney General, Dr Dominic Ayine thinks that the Speaker of Parliament, Alban Sumana Kingsford Bagin should abide by the orders of the Supreme Court staying the declaration of Four(4) Parliamentary seats vacant.
During an interview on TV3’s Hot Issues monitored by MyNewsGh.com, Dr Ayine stated that the orders of the court cannot be questioned but must be obeyed.
“The speaker should obey the orders of the court. This is because even if a court order is wrong, it must be obeyed. Unfortunately, that’s the position of the law.” He advised.
According to him, disobeying the court order is not an option. He emphasized that although the order from the court may be unpleasant, it is important to obey the order until it has been brought to notice and then be rectified.
While reacting to the members of parliament who have filed to be individual candidates, Dr Ayine said he would have resigned if he was in their shoes and concentrate on their independent candidacy.
A few days ago, the Supreme Court of Ghana issued a stay of execution on Speaker of Parliament Alban Bagbin’s ruling, which declared the seats of four Members of Parliament (MPs) vacant.
The affected MPs are Cynthia Morrison (Agona West), Kwadjo Asante (Suhum), Andrew Amoako Asiamah (Fomena), and Peter Kwakye Ackah (Amenfi Central).
This decision halts the implementation of the Speaker’s ruling pending further legal review. The ruling sparked a political storm, as it was seen as a critical moment in the ongoing contest between the Majority and Minority factions in Parliament.
In addition to granting the application, the court directed the Speaker and Attorney General to file their statement of case in the October 15 suit, filed by Afenyo-Markin, within seven days.
