Student files lawsuit against UG management over SRC elections

Asioh Joseph Mawuli, a second-year Bachelor of Arts student at the University of Ghana (UG), has filed a lawsuit against the university’s management concerning the Student Representative Council’s (SRC) elections.

This legal action follows the re-entry of hiplife icon Maradona Adjei Yeboah, popularly known as Guru NKZ, into the UGSRC presidential race. Guru had previously filed a petition against the Council’s Electoral Commission after being disqualified from the presidential race.

His disqualification was based on his non-resident status, which violates Article 30. This article mandates that candidates must be campus residents and eligible to contest for a Junior Common Room (JCR) position in their hall.

In his writ summons, Mawuli demanded a declaration that the decision by the SRC vetting committee to disqualify Adjei Yeboah Maradona and Emmanuel Owusu Amponsah for failing to meet the qualification requirement under Article 30(1)(a) of the SRC constitution is lawful and binding.

“A declaration that the jurisdiction of the Appeals Board was not invoked by any of the disqualified aspirants to warrant the overturning of the Judgment of the Judicial Board dated 15th September 2024 which upheld the decision of the vetting committee to disqualify Adjei Yeboah Maradona and Emmanuel Owusu Amponsah.”

“A declaration that the notice sent by the office of the 2nd Defendant directing the 4th Defendant to include Adjei Yeboah Maradona and Emmanuel Owusu Amponsah as candidates of the SRC election without an appellate decision overturning the Decision of the Judicial board is null, void and of no legal effect,” he stated.

Mr. Mawuli also seeks a declaration that an email sent by the 3rd Defendant, Prof. Gordon A. Awandare, Pro Vice-Chancellor, through the 2nd Defendant, Prof. Rosina Kyerematen, Dean of Students Affairs, UG, to the Electoral Commission and Judicial Board of the SRC, instructing them on how to conduct their affairs, was an attempt to interfere with the independence of the Judicial Board and the Electoral Commission.

“An order directed at the 1st, 2nd, and 3rd defendants to refrain from circumventing the laid down procedures by SRC constitution for dispute resolution.”

“An order directed at the 4th Defendant to refrain from including Adjei Yeboah Maradona and Emmanuel Owusu Amponsah in the list of candidates to partake in the balloting and subsequent contest of the 2024 SRC election of the University of Ghana.”

“Any order(s) this honourable court may deem fit,” he further stated.
