The Acting Managing Director of the Precious Minerals Marketing Company (PMMC), Sammy Gyamfi, has dismissed claims that President John Mahama acted unlawfully in forwarding petitions for the removal of Chief Justice Gertrude Araba Esaaba Sackey Torkornoo to the Council of State as reported by Ghana Web.
In a statement on his X account, Gyamfi defended Mahama’s decision, emphasizing that the President is following due process as outlined in Ghana’s legal framework.
He stated that the law requires the President to consult the Council of State before making any determination on such petitions.
Citing legal precedent, Gyamfi explained that Mahama is merely ensuring compliance with constitutional requirements.
“The President does not have the power to make this determination on his own but must do so in consultation with the Council of State,” he stated.
According to him, the petitions have been submitted in line with the procedures established by the Supreme Court in the Agyei Twum v. Attorney General case.
He further clarified that Mahama’s letter to the Council of State sought their input before taking any action on the matter.
Gyamfi stressed that the approach taken does not violate any law, dismissing suggestions of misconduct.
He maintained that Mahama’s actions are fully within legal bounds and align with established judicial processes.
Concluding his remarks, Gyamfi insisted that the former President has not acted improperly, as his actions are in line with constitutional dictates and legal precedent.
