Her Ladyship Angelina Mensah-Homiah, Supervising High Court Judge and Judge in Charge of Alternative Dispute Resolution (ADR), has encouraged the public to embrace ADR as a more efficient and cost-effective means of resolving legal disputes.
Speaking on behalf of Chief Justice Gertrude Sackey Torkornoo at the launch of Commercial ADR Week on March 17, 2025, themed “Building the Pillars of Justice Delivery through Commercial Justice ADR at the Court of Appeal Complex in Kumasi, she highlighted ADR’s role in reducing court congestion and fostering amicable settlements.
She noted that while litigation has long been the default method of dispute resolution, the evolving global landscape demands more flexible and efficient approaches.
Her Ladyship Mensah-Homiah further encouraged businesses and individuals to embrace ADR to ensure faster and more harmonious resolutions to conflicts, ultimately strengthening the pillars of justice delivery.
“ADR, a topic that lies at the connection of justice and economic stability. It is evident that mitigation has traditionally been the preferred approach within the legal profession.
“However, as the world evolves, so too must our methods for resolving disputes. There is a growing recognition of the need for that and an appreciation of more mechanisms for addressing disputes.
“A powerful solution in the realm of commercial disputes is ADR, which offers a constructive, effective, and the most efficient alternative through litigation.
“ADR may conveniently be described as appropriate dispute resolution. It is appropriate because it is very efficient, in fact, the most efficient dispute resolution mechanism.”She noted.
