According to GhanaWeb, legal tensions are escalating as attorney Bernard Bediako asserts that Ernest Yaw Kumi, the Member of Parliament for Akwatia, remains a convicted individual despite ongoing Supreme Court proceedings.

In a recent interview with GHOne TV’s court correspondent, Murtala Inusah, Bediako elaborated on the intricacies of Kumi’s legal situation.

He noted that the Supreme Court has expressed reservations about allowing Kumi, who is the applicant in the case, to receive a hearing.

This skepticism stems from Kumi’s previous conviction for contempt of court due to his noncompliance with court directives.

Bediako emphasized that the court is concerned about preserving its integrity.

He pointed out that it is inappropriate for someone in Kumi’s position to approach the Supreme Court while unresolved legal issues persist.

“The court was of the view that when such a situation arises, the sanctity of the court is at stake. You cannot run to the Supreme Court while an ongoing process has not been concluded and expect the court to cleanse you of your wrongdoing,” Bediako stated. 

Following discussions, the Supreme Court has mandated that the involved parties submit legal arguments within the next seven days to clarify the applicable legal framework.

A determination on Kumi’s eligibility for a hearing will be made on March 12.

The situation surrounding Kumi arises from a contempt ruling that led to his conviction, linked to a legal dispute regarding his candidacy and actions prior to securing his parliamentary position.

Despite being found guilty of ignoring a court order, Kumi contested and won the Akwatia seat, a decision that has faced legal challenges.

His political career has been marred by legal challenges, with critics questioning his right to serve in office due to his conviction.

The Supreme Court’s ruling on March 12 will be pivotal in deciding whether Kumi can continue with his appeal or if his legal issues will hinder his role as an MP.
