Sammy Darko was recently speaking at an event and he revealed that if they see Franklin Cudjoe and the latest Mercedes Benz, they have the power to stop and seize the car.

“They are few things I would love to talk about here today. Yes, the office of the special prosecutor has been given the power to do that and it’s doing that. And that brings back the conversation of unexplained wealth. Unexplained wealth is already criminal in Ghana. I think we are talking about the practicalizing of it, you know when the constitution provides for something larger, the constitution provides in article 2, 8, 4 that if your lawful income does not match your assets, you must be made to explain”.
“All I’m trying to say is that it’s erroneous when we say, Ghana does not have unexplained wealth law. Ghana has unexplained wealth law but the challenge here and I will come to it is the reverse burden they talk about so currently if you take the office of the special prosecutor, when we see Franklin Cudjoe driving the latest Mercedes Benz, yes we have the power to stop you and seize your car that very moment and we can keep the vehicle for up to 7 days without going to court, to enable us investigate you”.
“Now the problem is that, sometimes when you have investigated someone, when he was committing the corruption, we were not there so sometimes it’s very difficult trying to link whatever he has acquired to the corruption, so when we say the reverse burden for the law enforcement agency, what we are trying to say is that, we should be able to demonstrate that, we should put Franklin Cudjoe’s lawful income together and if we realized that he can’t afford the vehicle, then he will now tell us how he got it”, Sammy Darko said.
