The Supreme Court has released a detailed explanation for upholding the suit filed by Majority Leader Alexander Afenyo-Markin against Speaker Alban Bagbin’s declaration of four seats as vacant.
According to the court, a Member of Parliament (MP) is considered to have vacated their seat only if they change their political identity and continue to serve in Parliament under the new identity.
In its judgment supporting the suit brought by the Majority Leader, the court clarified that Articles 97(1)(g) and (h) of the Constitution apply solely to the current term of Parliament.
These provisions do not extend to future terms, such as when an MP runs for elections under a different political affiliation.
The court emphasised that an MP’s seat is vacated if they switch parties within Parliament while continuing to serve as a member of the new party.
