The Ghana Police Service requested that Arise Ghana be restrained and prevented from starting a demonstration that would halt at 10 p.m., and the Criminal Division of the Accra High Court has largely granted that request.
According to the request, the police asked the court to get involved to stop the planned rally from going into the night. DSP Sylvester Asare used concerns of terrorism in the neighboring country of Togo to support his position and demanded that the demonstration halt at three o’clock.
Godwin Edudzie Tamakloe, the lead attorney for the respondent (Arise Ghana), said that the police had not shown how the terrorist attacks in Togo that occurred in the afternoon would affect a demonstration that was scheduled to take place in Ghana at night.
The location of the demonstration and the time it would stop were the points of difference between the Police and Arise Ghana that led to litigation. While partially allowing the application, the court ruled over by Justice Comfort Tasiame ordered that the protesters should gather at Obra Sport, travel down Farrisco Avenue to TUC, and complete their demonstration at the Independent Square.
The planned demonstration, according to the court, should begin at 8am and end at 4pm. The court ruled that the President’s representative, if there is one, should accept the petition.
