Latest On Assin North Election Case: It Is Now The Republic Against James Quayson

The legal battle against the National Democratic Congress’s (NDC), Member of Parliament for Assin North, Honorable James Gyakye Quayson, is still on and moving from one stage to another.

The case started from the High Court, moved to the Supreme Court of Ghana, and now back to the High Court. At this stage, it is the Republic of Ghana against James Quayson.

Following the ruling by the High Court in July, 2021; (which nullified the election of Honorable Quayson as a member of parliament for Assin North Constituency), the Supreme Court in a majority (5-2) decision also ruled that, the Assin North MP, can no longer perform Parliamentary duties.

According to the Supreme Court’s ruling , on Wednesday, April 13 2022, “The application succeeds. The MP (Honorable James Gyakye Quayson), is restrained from holding himself as MP for Assin North, and restrained from attending Parliament to conduct business on behalf of the people of Assin north. The restriction remains until the final determination of the substantive matter. We direct that the case hearing be expedited”.

Hon Quayson, not satisfied with the Supreme Court’s decision, filed a review application at the Supreme Court; arguing that, the court’s ruling was a patent and fundamental error of the law; and a breach of portions of Ghana’s constitution.

In his application for review, Hon Quayson maintained that “…the court’s decision failed to appreciate that, the suit was in reality an attempt to enforce the decision of the High Court, disguised as an invocation of the original jurisdiction of the Supreme Court”.

The review application case, which was heard on Tuesday, 17 May 2022, was again adjourned.

In the latest development, the High Court has decided on June 1, 2022, to sit and fix a date for the criminal trial of the embattled Assin North Member of Parliament.

In this case, (between the Republic and James Quayson), the Republic is bringing criminal charges against the embattled MP, Hon. Quayson, “on the deceit of public officer, forgery of passport or travel certificate, knowingly making a false statutory declaration in contravention of the statutory declarations, perjury, and false declaration for office”.

According to the Republic, Hon Quayson committed the offences knowingly, which led to his victory in the December 2020 parliamentary elections.

The date for the hearing will be decided in June 2022.
