The Current State of Homosexuality in Ghana

The government of Ghana has been trying to crack down on homosexuality in Ghana. Homosexuality was illegal in the British colony of Ghana, and it is still basically illegal today. In real life, however, people who are homosexual don’t try to hide their sexual orientation.

In 2009 a regional court found that Article 63 of the penal code does not apply to same-sex intercourse but only covers heterosexuals, and so it is not applicable for two consenting adults of the same sex.

In a report by the Ghanaian Center for Democratic Development (CDD) it was reported that homosexuality is not illegal in Ghana. But because of other legal provisions, homosexuals may still face the risk of being arrested, detained and charged with some other offenses such as public indecency or disturbing the peace.

The report stated that Ghanaian laws do not make homosexual acts a crime, although certain laws are sometimes used against homosexuals who are targeted under general criminal laws. The CDD also stated that there is no law in Ghana prohibiting discrimination against people on the basis of their sexual orientation; however, this does not mean that homosexuals have equal rights enjoyed by heterosexual citizens.
