It is emerging that the chief justice of Ghana, Justice Kwesi Annin Yeboah is interfering in the case of Opuni, Seidu Agongo and Agricult Ltd. According to Justice Clemence Honyenuga who is sitting on the case, Justice Annin Yeboah has given him orders to finish the case within a specific period of time. The presiding judge made this disclosure in open court on Thursday when the case was called. Due to that orders, the court is compelled to sit on the case twice in a week instead of once in a fortnight.
“In accordance with Article 112(2) of the 1992 Constitution, the Chief Justice has granted me a limited time to complete this case. In these circumstances, this court is also scheduled to sit Tuesdays at 11:00 a.m. for the early settlement of this four-year-old case. In light of the upcoming holiday, the case is adjourned to October 3, 2022 at 10:00 a.m. for continuation“, Justice Honyenuga stated in court.
Meanwhile, a retired Deputy Director in charge of oversight and evaluation of the Cocoa Health and Extension Division (CHED) of the Ghana Cocoa Board (Cocobod), Mr. Peter Okyere Boateng, was in court to testify to the effectiveness of Lithovit fertiliser which is at the center of the controversy.
According to him, the fertiliser was very effective according to the farmers. He added that Lithovit was termed as the farmers saviour as it helped in increasing productivity.
“Lithovit foliar fertilizer is a very good, efficient and effective product that has the potential to help farmers increase their yield and therefor increasing their finances. The report I prepared and forwarded to Ghana COCOBOD through my director included information on the efficiency of the Lithovit liquid fertilizer as observed by all the teams who visited all the cocoa regions, as well as the praise sung by the farmers after application, the effectiveness of the Lithovit liquid fertilizer was fully accepted and the recommendation for the product was implemented, according to the statement [of Cocobod] was that the product is good”, Mr. Boateng stated.
He also disputed the allegation that there was was fraud in relation to the contract.
“Sir, I don’t really know the basis of the fraud. So this can’t be true. Because everything indicates that Lithovit liquid fertilizer was procured with the money. The Lithovit liquid fertilizer has also been demonstrably delivered to cocoa farmers for application. And everything indicates that after using the Lithovit liquid fertilizer, the farmers got high yields, which increased their income. So the money was used efficiently. Therefore, there can be no fraud in this matter”, Peter Okyere Boateng stated.
