The Supreme Court Justices Must Come Out To Explain Their Power To Make Rules Without Due Process

A US-based Ghanaian lawyer and a Professor in Accounting, Stephen Kwaku Asare aka Kwaku Azar has asked the Supreme Court Justices to come out and explain their power to make rules without hint of due process.

In a post shared on his official Facebook page on Thursday, 28th July 2022, he wrote;

“Justices Yeboah, Dotse, Bonnie, Pwamang, and Kotey never took an exam with an unknown passing score.”

Kwaku Azar said that they know or ought to know that such a mystery passing regime (MPR) is unfair and unreasonable and violate Article 23 of the Constitution that they have sworn to uphold, protect, and preserve.

“They must come out and explain why they have chosen to impose this MPR on others when they will not subject themselves to a similar regime. He wrote.

“They must come out to explain the rulemaking doctrine that underwrite their power to make rules without notice, hearing or any hint of due process”. Prof Azar demanded.

Background

The comments of Prof Azar comes as a background to the announcement made by General Legal Council for students who want to study law.

“Eligible Applicants who attain the minimum threshold mark set by the General Legal Council for this particular year will be offered admission for the 2022/2023 Academic Year to pursue the Professional Law Course.”

Prof Azar believe that the pass rate is whatever the Lords say it is. Hence it’s unfair and the required pass marks must be annouced.
