The Law Court Will Never Grant A Divorce In Marriage In Only This Instance.

People marry young, share good and bad times, have a family and begin to fight. Sometime suddenly married couples feel alone when they are with their partner and this often among other bad habits can produce resentment and divorce.

While aggrieved couples may seek legal redress at the law court to settle any indifferences it however relevant to know that there are certain instances the law court will never grant a divorce in marriage. The court will not allow petition for a divorce within the first two years of marriage unless on the ground of substantial hardship suffered by the petitioner or depravity on the part of the respondent.

The Matrimonial Causes Act, 1971 (Act 367), governs the current law on divorce in Ghana. The law provides that a petition for divorce may be presented to the Court by either party to a marriage. However, the Petitioner of the divorce, i.e. the person who starts the proceedings must be able to provide evidence to the effect that the marriage has broken down beyond reconciliation . This is the sole ground for divorce.
